Terms of Service v4.0

You must be at least 18 years old to use BreakrAI. By creating an account or using the Service, you represent and warrant that: (a) you are 18 or older; (b) you have the legal capacity to form a binding contract; and (c) you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

BreakrAI is a behavioral self-help and habit-tracking application offering: streak tracking, AI-powered coaching conversations, CBT-inspired exercises, progress analytics, mood check-ins, and relapse logging.

BreakrAI is not a medical service, clinical therapy platform, regulated mental health application, or licensed counseling service under any jurisdiction. The AI coach is a conversational support tool — not a licensed therapist, psychiatrist, or clinician. CBT-inspired exercises are self-guided tools, not clinical CBT delivered by a qualified professional.

You are solely responsible for your account credentials. Notify us immediately of unauthorized access at help@breakrai.com. We are not liable for losses from unauthorized use of your account.

Creating multiple accounts to circumvent usage limits is prohibited and may result in permanent termination of all associated accounts without refund.

You agree to provide accurate, current, and complete information at registration and to keep it updated.

• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international laws
• Attempt to reverse-engineer, decompile, hack, scrape, or disrupt the Service or its infrastructure
• Input into the AI chat content that is harmful, abusive, violent, sexually explicit, illegal, or designed to "jailbreak" the AI
• Impersonate any person, entity, or BreakrAI itself
• Circumvent or attempt to bypass subscription paywalls, usage limits, or access controls
• Use automated bots, scripts, or crawlers to access the Service
• Reproduce, distribute, sublicense, or commercially exploit any part of the Service without prior written permission
• Use the Service to harm, harass, or stalk any person

BreakrAI offers a free tier with limited AI messages per day and access to core features. Free-tier limits are controlled via Remote Config and may change without prior notice.

Pro subscriptions provide unlimited AI messaging and full feature access. Current pricing is displayed on the Paywall screen immediately before any purchase. Prices are dynamic and subject to change; changes will not affect active subscriptions until renewal.

Subscriptions are billed on the cycle shown at checkout (currently annual). Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time; Pro access continues until the end of the current paid period. No partial refunds for unused time.

Web (direct purchase): Refund requests within 7 days of initial purchase may be considered at our sole discretion. Email help@breakrai.com.

Apple App Store purchases: Governed exclusively by Apple's refund policy. We have no authority to issue refunds for App Store purchases.

Google Play purchases: Governed exclusively by Google Play's refund policy. We have no authority to issue refunds for Play Store purchases.

All content, code, design, UI/UX, trademarks, logos, text, graphics, and materials comprising the BreakrAI Service are the exclusive intellectual property of BreakrAI, protected by copyright, trademark, and other applicable intellectual property laws worldwide. The "BreakrAI" name and logo are proprietary marks of BreakrAI.

No part of the Service may be copied, reproduced, distributed, modified, adapted, transmitted, publicly displayed, or commercially exploited without prior written permission from BreakrAI.

Journal entries, chat messages, and other content you create ("User Content") remain your property. You grant BreakrAI a limited, non-exclusive, non-transferable, royalty-free license to store, process, and display your User Content solely to provide the Service to you. This license terminates when you delete your account.

Any feedback, suggestions, or ideas you submit to us become the property of BreakrAI. We may use such feedback without restriction or compensation to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION: WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

BREAKRAI DOES NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) ANY ERRORS WILL BE CORRECTED; (C) AI RESPONSES WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR SITUATION. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BREAKRAI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, HEALTH OUTCOMES, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BREAKRAI'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID BREAKRAI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) USD $50.00.

BREAKRAI MAKES NO GUARANTEES REGARDING RECOVERY OUTCOMES. RESULTS VARY BY INDIVIDUAL AND ARE OUTSIDE OUR CONTROL.

BreakrAI shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics, acts of government, war, internet or infrastructure outages, third-party service failures (including Google Firebase or Anthropic API), cyberattacks, or other force majeure events. Our performance obligations are suspended for the duration of such events.

You agree to indemnify, defend, and hold harmless BreakrAI and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your violation of these Terms; (b) your misuse of the Service; (c) your User Content; or (d) your violation of any third-party rights.

We may suspend or terminate your account immediately, without notice or liability, for any violation of these Terms, any conduct we deem harmful, or at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including IP ownership, warranty disclaimers, indemnification, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law provisions.

Before initiating legal proceedings, you agree to contact us at help@breakrai.com and attempt good-faith resolution for at least 30 days.

Any disputes must be brought on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against BreakrAI.

EU / UK Exception: If you are a resident of the European Union or the United Kingdom, the class action waiver above does not apply to you to the extent it conflicts with your mandatory consumer protection rights under EU or UK law.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and BreakrAI and supersede all prior agreements.

We may update these Terms at any time. Material changes will be communicated via in-app notification and/or email at least 14 days before effect. Continued use constitutes acceptance.
